Terms of Service

These Terms of Service (“Terms”) govern your use of povPR (the “Service”), operated by the operator of povPR. Please read them carefully. They include important disclaimers about our automated and AI-assisted content, a disclaimer of warranties, and a limitation of liability.

1. Agreement

By accessing or using povPR, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Service.

2. The service

povPR is a free, ad-supported news-literacy tool that groups publicly available news articles about Puerto Rico, shows which outlets have and have not covered a story, and provides context and automated analysis about coverage. To keep the Service fair and available for everyone, we may apply reasonable rate limits and may change, suspend, or discontinue any feature at any time.

3. Eligibility

You must be at least 13 years old (or 16 in the EEA/UK) to use the Service. By using povPR, you confirm that you meet this requirement.

4. No accounts

No account or sign-up is required to use povPR. You are responsible for your own use of the Service and for complying with these Terms each time you access it.

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Scrape, crawl, or automate access beyond normal browser use, or attempt to bypass rate limits or security measures.
  • Reverse engineer, decompile, or interfere with the Service or the servers and networks that run it.
  • Copy, reproduce, or redistribute substantial portions of the Service or its underlying database in a way that competes with it or that infringes third-party rights.
  • Misrepresent povPR’s automated output as verified fact or as an accusation against any person or outlet.

We may investigate and take appropriate action, including blocking access, for any violation.

6. Your submissions

If you send us feedback, corrections, or other communications, you grant us a non-exclusive, royalty-free license to use them to operate and improve the Service. You are responsible for what you send and confirm you have the right to send it. Do not submit confidential or personal information about others.

7. Intellectual property & news content

The povPR name, logo, website design, and software are owned by the operator of povPR and protected by intellectual property laws. You may not use them without permission.

News headlines, excerpts, and metadata displayed on the Service belong to their respective publishers and are shown for news-reporting, commentary, and criticism purposes with attribution and links back to the original outlet. We do not republish the full text of articles. If you are a rights holder and believe content has been used improperly, contact us using the copyright process in Section 20 and we will respond promptly.

8. Editorial & AI disclaimer

This section consolidates the disclaimers that apply throughout povPR. Story summaries, coverage notes, coverage-gap (“blindspot”) flags, and micro-audits are generated automatically with the help of AI language models and statistical clustering.

  • Automated output is probabilistic and may be incomplete, arrive late, miss relevant articles, or contain errors. Use it as a signal to orient yourself, not as final truth.
  • A “coverage gap” or “blindspot” means only that we have not found coverage in the sources we track yet. It is not a statement that any outlet censored, suppressed, or intentionally ignored a story, and it should not be read as an accusation against any person or organization.
  • Source profiles describe ownership, funding, and context for general media-literacy purposes. They are not verdicts on the accuracy or integrity of any specific article.
  • povPR is a creative and educational tool, not a source of factual or legal determinations. Verify information against the original outlets before relying on or republishing it.

9. Third-party services & links

The Service links to third-party news outlets and relies on third-party providers (including hosting, database, analytics, advertising, and AI model providers). We do not control and are not responsible for third-party websites, content, or practices, and your use of them is subject to their own terms and privacy policies.

10. Advertising

The Service may display advertising to help keep it free. We are not responsible for the content of advertisements or for the products or services they promote. See our Privacy Policy for how advertising cookies work and how to opt out.

11. Fulfillment policy

povPRis currently provided free of charge. Access to the Service is “fulfilled” by making the website available to you online; there is no physical product and nothing is shipped.

If we introduce paid features, subscriptions, or voluntary contributions in the future, they will be delivered electronically. Any purchase will be processed by a third-party payment provider or merchant of record, and access to the purchased feature will typically be granted immediately or as described at the point of purchase. The specific terms, price, and billing cycle will be disclosed to you clearly and conspicuously before you complete any purchase.

12. Refund policy

Because povPR is currently free, no payments are collected and no refunds are applicable.

If paid offerings are introduced, the following will apply unless a different policy is stated at the point of purchase:

  • Digital nature: digital features and subscriptions are delivered electronically and may be non-refundable once access has begun, except where a refund is required by law.
  • Goodwill exceptions: we will consider refunds for accidental duplicate charges or a technical failure that prevented access.
  • EU/UK withdrawal right: consumers in the EEA/UK have a statutory 14-day right to withdraw from a distance contract. For digital content delivered immediately, this right may be waived only where you have given prior express consent and acknowledged the loss of the right at checkout. We will provide a clear digital way to exercise the right of withdrawal where it applies.
  • Statutory rights: nothing in this policy limits any non-waivable consumer protection rights you have under the laws of your jurisdiction (for example, consumer guarantees in Australia).

13. Free service / no SLA

The Service is provided free of charge on a best-effort basis. We do not guarantee uninterrupted operation, feature availability, response times, data freshness, or output quality, and we may rate-limit, suspend, or discontinue features at our discretion without prior notice. We are not liable for any unavailability or discontinuation of the Service.

14. Disclaimer of warranties

THE SERVICE AND ALL CONTENT, INCLUDING AUTOMATED AND AI-GENERATED ANALYSIS, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. POVPR DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY COVERAGE ANALYSIS, SUMMARY, OR GAP FLAG WILL BE ACCURATE, COMPLETE, TIMELY, OR RELIABLE.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

15. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR OF POVPR AND ITS CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REPUTATION, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE OR ITS AUTOMATED CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD $100.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you. In those jurisdictions, our liability is limited to the maximum extent permitted by law. Nothing in these Terms excludes liability that cannot be excluded by law.

16. Indemnification

You agree to indemnify and hold harmless the operator of povPR and its contributors from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party right.

17. Termination

We may suspend or block access to the Service for anyone who violates these Terms or where necessary to protect the Service or its users. Provisions that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, and governing law) will survive.

18. Governing law & venue

These Terms are governed by the laws of the Commonwealth of Puerto Rico, United States, without regard to conflict-of-law principles. You agree that any dispute will be brought exclusively in the courts located in San Juan, Puerto Rico, and you consent to their jurisdiction. Where a party is unable to bring a claim there, the parties consent to the United States District Court for the District of Puerto Rico as an alternate forum. Nothing in this section deprives you of the protection of mandatory consumer laws of your country of residence.

19. Changes

We may update these Terms from time to time. Material changes will be posted here with a new “Last updated” date. Your continued use of povPR after changes are posted constitutes acceptance of the revised Terms.

Copyright / DMCA: If you believe content on the Service infringes your copyright, send a notice to founders@povpr.news that includes: (1) your contact information; (2) identification of the copyrighted work; (3) the URL of the material you want removed; (4) a statement that you have a good-faith belief the use is not authorized; (5) a statement, under penalty of perjury, that your notice is accurate and you are authorized to act; and (6) your physical or electronic signature. We will respond in accordance with applicable law.
